甲方基于下文所列各种因素，特与乙方达成了协议并一致同意：由甲方在订约日期之翌日起_____天之内为乙方建造并完成_____（涉约建筑）。涉约建筑之规模及所需的钢筋、水泥、砖块、石子和其它建筑材料之数量，均在作为附件的设计图和施工细则中予以说明。

Witnesses that the Party A for considerations hereinafter named, contractsand agrees with the Party B that Party A will, within_____ days, next followingthe date hereof, build and finish a Libarary Building for Party B. ( thebuilding hereinafter is referred to as the said building.) The said building isof the following dimensions, with reinforced concrete, brick, stones and othermaterials, as are described in plans and specifications gereto annexed.

基于上述情况，乙方及其法定代表郑重承诺向甲方支付人民币_____元整。支付方法商定如下：

In consideration of the foregoing, Party B shall, for itself and its legalrepresentatives, promise to pay Party A the sum of one million RMB yuan inmanner as follows, to wit：

订约双方并同意由甲方或其法定代表在领取各项付款时，为证明有权领用上述各次付款（第一次付款除外，因其另有保证），必须由建筑师作出评定，证明已经收到的付款之价值已经消耗在劳务及材料费用之中。

It is further agreed that in order to be entitled to the said payments ( thefirst one excepted, which is otherwise secured ), Party A or its legalrepresentatives shall, according to the architect’s appraisement, have expended,in labor and material, the value of the payments already received by Party A, onthe building, at the time of payment.

上述协议如未能忠实执行，则违约一方同意其应享有权利自动丧失，且在违约之日后一个月之内，向对方或其法定代表赔偿人民币_____元整，作为商定之损失赔偿费。

For failure to accomplish the faithful performance of the agreementaforesaid, the party so failing agrees to forfeit and pay to the other_____RMByuan as fixed and settled damages, within one month form the time sofailing.
